Food Safety Gets a Boost: FSSAI Imposes 45-Day Shelf Life for Online Deliveries

Publishing Date: 05 Dec, 2024

Introduction

FSSAI is an established apex body that sets rules and regulations and it is mandatory for all to do FSSAI Registration to run any food business in India. The Food Safety and Standard Authority of India (FSSAI) recently announced certain regulations that are mandatory for all online platforms to deliver food items with a minimum shelf life of 45 days in order to enhance food safety across India. This decision has created critical implications for e-commerce platforms and food producers, however, it is welcomed by consumers and food safety advocates largely. In order to provide quality goods to consumers this decision is taken by the FSSAI committee and an advisory is issued on 3rd December by FSSAI CEO. In this article we will discuss this advisory in detail along with challenges and consideration for E-Commerce businesses.

Advisory for E-commerce Food Business Operators

The FSSAI directed e-commerce food business operators (FBOs) to comply with the following regulations:

  1. Training of last-mile delivery personnel: E-commerce FBOs must train their delivery staff in food safety and hygiene practices, ensuring safe handling and transportation. Additionally, they should guarantee the separate delivery of food and non-food items to prevent cross-contamination risks.

  2. Ensuring Label Accuracy: FBOs must ensure that product claims on their platforms align with the information on the product’s physical label, preventing any misleading or unsubstantiated statements. Additionally, they should implement systems to comply with the Food Safety and Standards (Labelling and Display) Regulations, 2020.

  3. Minimum Shelf-life: To ensure consumer confidence, FSSAI requires delivered food products to have at least 30% shelf life remaining or a minimum of 45 days until expiry.

  4. Enhancing Transparency: In line with FSSAI’s commitment to transparency, e-commerce platforms are urged to clearly display the FSSAI License/Registration numbers of sellers and the Hygiene Ratings of food business operators. This will boost consumer trust and help them make informed purchasing decisions.

Why does this regulation matter?

These regulations by FSSAI create a large impact on consumers, manufacturers & sellers. Following are some importance of this advisory by FSSAI:

  1. Consumer Health:
This regulation directly creates a large impact on consumers' health, it will enhance the safety and quality of food items which will protect the health of its consumers. Some concern regarding getting products close to expiry dates and less time for safe consumption were seen. With a 45 day window, buyers can get enough time and will be more confident about the food in respect of taste and nutritional benefits.

  2. Ensuring Compliance from Sellers:
This mandate requires e-commerce platforms and suppliers to strictly monitor inventory and ensure products meet the shelf-life requirement, reducing the risk of near-expiry or substandard goods being sold.

  3. Strengthening India’s Food Safety Framework:
FSSAI’s directive follows global best practices and reinforces India’s food regulatory framework. This step indicates a move toward stricter compliance, encouraging the industry to raise its operational standards. Ultimately, such measures help build trust in the online food delivery ecosystem.

Challenges and Considerations

While this mandate is a significant advancement, it does raise challenges:

  • Logistical Hurdles: Ensuring compliance across India’s vast and varied supply chains could be difficult for rural suppliers and smaller players. They might require support and guidance to adapt.
  • Increased Costs: Compliance may lead to higher operational costs for both e-commerce platforms and suppliers. These costs might be passed on to consumers, at least initially.
  • Monitoring and Enforcement: FSSAI will need to establish robust monitoring mechanisms to ensure compliance. Regular audits and inspections will be critical to the directive’s success.

Conclusion

The FSSAI’s 45-day shelf life regulation is a crucial step for ensuring safe and high-quality food in India’s growing online delivery sector. By mandating that consumers receive products with ample shelf life, the regulation fosters trust and transparency. While it presents initial challenges for e-commerce platforms and suppliers, the long term benefits of improved safety standards and consumer confidence are significant. This move not only elevates industry practices but also sets a strong precedent for a more responsible and accountable food supply chain in India.
